General terms and conditions

These conditions govern both the use of the auction platform and the purchase agreement with the seller mentioned for the koi in question.

1. Roles and Applicability

import/export Interkoi (Interkoi Ameide) manages the website and technical bidding functionality. Interkoi Ameide is only the seller if this is expressly indicated for the koi in question.

The location where the koi is kept determines the seller: Interkoi Ameide is the seller for the Ameide - NL location, and Grendel-Koi is the seller for the Asbach - D location. The purchase agreement is concluded exclusively between the buyer and the stated seller.

The platform conditions in Articles 1 to 5 apply to all users. The terms and conditions of sale in Articles 6 to 15 apply between the buyer and the seller listed with the koi. Individual written agreements have priority.

2. Registration and participation

Participation requires a personal account with complete and correct details. The user must be legally competent and at least eighteen years old. Business users provide their correct company details.

Login details are personal. In cases of misuse, overdue payment, manipulation or a serious breach of these terms, the platform operator may temporarily block an account or refuse participation, without affecting obligations already incurred.

3. Information about the koi

Where available, each listing states the seller, location, breeder, variety, age, sex, length, photos, videos, starting price, bid increment and end time. Measurements are approximate unless expressly agreed otherwise.

Koi are living animals. Color, markings, body structure, health and development may change after the images are taken. Statements regarding growth, future quality or show results are expectations and not guarantees. Legal rights due to a defect remain unaffected.

4. Bidding and automatic bidding

A bid is only made via the appropriate function. The bidder checks the koi, the seller, the amount, the bidding step, the end time and the applicable conditions before confirmation.

By placing a binding bid, the bidder makes a binding offer to purchase the koi for the bid amount if they become the valid winner. Any input error must be reported immediately using the platform contact details. Statutory rights of withdrawal and annulment remain unaffected.

With automatic bidding, a maximum bid can be set. The system only increases the bid by the applicable bidding steps up to this maximum. The maximum bid remains hidden from other bidders. In the event of equal maximums, the first registered maximum bid takes priority.

5. End of the auction and conclusion of the agreement

The platform's server clock is decisive. When bidding takes place in the last minutes, the end time can be automatically extended in accordance with the arrangement stated in the auction.

The purchase agreement is concluded at the end of the auction with the highest valid bidder, provided that any stated minimum or reservation has been reached. The winner will receive a confirmation with the koi, purchase price and seller. In the case of a subsequent offer, the agreement is only concluded when the seller expressly accepts the offer.

In the event of a demonstrable technical error, manipulation, illness or death of the koi before the award, the platform operator may interrupt, extend or cancel the auction before the conclusion of the agreement. After conclusion, the agreement and the legal rights of both parties remain leading.

6. Purchase price and payment

The winning bid is the purchase price. Statutory VAT is included where applicable. Transport, special holding and additional services are payable only if stated before the bid or agreed separately with the buyer afterwards.

The listed seller will invoice the buyer directly. Unless otherwise stated at the auction, the purchase price must be paid in euros by bank transfer within seven calendar days after the end of the auction, using the payment details on the invoice. A seller can also expressly offer another payment method.

7. Collection, housing and transport

Unless otherwise agreed, the koi will be collected by appointment from the stated location within thirty calendar days after the end of the auction. Longer accommodation requires a prior appointment and can take place after the free period for a reasonable fee communicated in advance.

Transport only takes place after a separate agreement. The buyer bears the agreed transport costs. For consumers, the risk is transferred in accordance with the mandatory legal rules; a different transfer of risk to the detriment of the consumer is not agreed.

8. Health, Death and Legal Rights

The seller will professionally care for the koi until the agreed transfer. Illness, injury or death is investigated on a case-by-case basis. Voluntary leniency, for example a voucher or replacement koi, never limits mandatory legal claims.

Any problem during delivery or collection must be reported to the seller as soon as possible, preferably with clear photos or videos and relevant transport information. A reporting period of twenty-four hours is intended for rapid determination and does not exclude statutory consumer rights.

9. Right of withdrawal for consumers

An auction held exclusively online is not automatically a publicly accessible auction whereby the statutory right of withdrawal lapses. If the buyer is a consumer and no legal exception applies, the statutory right of withdrawal applies.

Use the electronic withdrawal function or read the withdrawal instructions and the model form.

10. Non-payment and non-collection

In the event of non-payment or failure to collect, the seller may grant a reasonable additional period and then exercise their statutory rights. Following an unheeded warning, the account may be blocked from future auctions. Blocking an account does not terminate an agreement already concluded.

11. Technical Availability and Prohibited Uses

Manipulation, sham bidding, use of third party accounts, automated bidding requests outside the functions offered and abuse of technical weaknesses are prohibited. If there is a well-founded suspicion, the account may be temporarily blocked and the incident investigated.

The platform is kept available with appropriate care. Failures beyond reasonable control may lead to interruption, extension or restart when this is necessary for fair conduct. Compelling legal claims continue to exist.

12. Liability

The platform operator and the seller have unlimited liability for intent and gross negligence, for damage to life, body or health and in all other cases where the law prescribes unlimited liability.

In the event of slight negligence, liability is limited to foreseeable, typical damage in the event of breach of an essential contractual obligation. This limitation does not apply to mandatory consumer rights, product liability or express warranties.

13. Data and Evidence

To ensure an orderly process, accounts, bids, timestamps, awards, payment and collection status, and necessary technical events are recorded. The platform operator shares the data required to perform the agreement with the stated seller. Further information is provided in the Privacy Policy.

14. Applicable law and mandatory consumer protection

Dutch law applies to the use of the platform. The law of the state of residence of the mentioned seller applies to the purchase agreement: Dutch law at Interkoi Ameide and German law at Grendel-Koi.

This choice of law does not deprive consumers of the protection of mandatory provisions of the law of their habitual residence. Legal rules regarding competent courts remain applicable; no exclusive deviating court is agreed for consumers.

15. Changes and valid version

A bid is subject to the terms and conditions published at the time of confirmation. Changes after the offer have no retroactive effect. If a provision is invalid, the other provisions remain in force and the statutory regulations apply to that provision.

For koi at the Ameide - NL location, Interkoi Ameide is the seller, the invoicing party and the point of contact for payment, collection, transport, statutory warranty and withdrawal.

Auktions and sales conditions Grendel-Koi

For koi at the Asbach - D location, Grendel-Koi is the seller, the invoicing party and the point of contact for payment, collection, transport, statutory warranty and withdrawal. Articles 1 to 15, together with this seller section, constitute the applicable Auktionsbedingungen of Grendel-Koi.

Grendel-Koi is neither obliged nor willing to participate in a dispute settlement procedure before a German consumer dispute board (§ 36 VSBG).
